Terms and Conditions
1. Scope
1.1 These General Terms and Conditions govern the legal relationship between the Vienna Philharmonic Association, ZVR: 916027886, Bösendorferstr. 12, A-1010 Vienna (Email: info@wienerphilharmoniker.at, Tel: +43 (1) 505 6525), represented by the Board of Directors, which is represented by Chairman Daniel Froschauer at the same address (hereinafter referred to as the Vienna Philharmonic), and the visitors to its events or the users of the Vienna Philharmonic’s website and online store (visitors or users hereinafter referred to as “Customers”).

2. Webshop
2.1 Use of the Webshop requires free registration and login on the Vienna Philharmonic’s website.
2.2 Concert tickets, ball tickets, audio and video recordings, books, clothing, gift items, and other products may be purchased in the online store (collectively referred to as the “product range”; individually as the “product”).
2.3 The customer may select various products from the Vienna Philharmonic’s online store product range and add them to a shopping cart. Before submitting the order, the customer may at any time modify, view, or deselect the chosen products, or cancel the purchase process entirely. Upon submitting an order via the “Place Order” button, the customer makes a binding offer to purchase the products in the shopping cart.
2.4 The total price of the order is due immediately. The Vienna Philharmonic supports the following payment methods: credit card, SOFORT Überweisung, and PayPal. The payment method may be changed for each order. The Vienna Philharmonic reserves the right not to support certain payment methods in individual cases. Once the bank details have been provided, the payment will be debited from the customer’s account via the website of the payment service provider, Qenta Payment CEE GmbH.
2.5 Immediately after the payment has been processed, the customer will receive an email confirming the order (which can also be printed separately using the “Print” function). The automatically generated email merely documents that the Vienna Philharmonic has received the customer’s order. It does not constitute acceptance of the customer’s binding offer. The contract is only concluded upon the issuance of a separate invoice.
2.6 Products are sold only in quantities customary for household use.
3. Product Availability
3.1 If a specific product ordered by the customer is permanently unavailable at the time of the customer’s order, the Vienna Philharmonic will immediately inform the customer of this via email. In this case, the contract is not concluded. The acceptance of the order for other products remains unaffected.
3.2 If a product ordered by the customer is only temporarily unavailable, the Vienna Philharmonic will also notify the customer. If there is a shipping delay of more than two weeks from the date the order confirmation is sent, the customer has the right to cancel the contract.
3.3 In the event of withdrawal from the contract, the Vienna Philharmonic will immediately refund any payments already made by the customer in accordance with Section 7.
4. Tickets
4.1 General
4.1.1 Tickets (“concert tickets” or “ball tickets”) may be purchased in person at the ticket office (Vienna Philharmonic Ticket and Ball Office, Kärntner Ring 12, 1010 Vienna, Tel +43 (1) 505 6525) in person, by phone using a credit card, or via the web shop in accordance with the terms of these General Terms and Conditions. For ball tickets, the provisions of Section 4.3 of these General Terms and Conditions apply in addition.
4.1.2 Reservations for concert and ball tickets are not possible.
4.1.3 Concert tickets for the preview of the New Year’s Concert, the New Year’s Eve Concert, and the New Year’s Concert are allocated by online lottery (see Section 4.2 of these General Terms and Conditions). The provisions of Section 4.4 of these General Terms and Conditions apply to the allocation of Vienna Philharmonic subscriptions.
4.1.4 During the week preceding a subscription concert (Saturday/Sunday), tickets on consignment for these concerts may be purchased starting on Monday of that week (for Soireés, starting one week in advance), as long as they are available. Tickets on consignment are generally available only in limited quantities.
4.1.5 There is no right to return or exchange purchased tickets. The customer acknowledges that changes to the lineup or program may be necessary—for example, due to illness—in which case the Vienna Philharmonic will, to the extent possible, ensure an adequate replacement or program change. In such cases, as well as in cases of restricted visibility necessitated by stage expansions, there is no entitlement to a refund of the ticket price.
4.2 Tickets for the Preview of the New Year’s Concert, the New Year’s Eve Concert, and the New Year’s Concert
4.2.1 Tickets for the preview of the New Year’s Concert (December 30, 11:00 a.m.), the New Year’s Eve Concert (December 31, 7:30 p.m.), and the New Year’s Concert (January 1, 11:15 a.m.) will be allocated by random online lottery due to high demand. They are not available directly in the web shop or at the box office.
4.2.2 To be eligible to participate in the drawing, you must register on the Vienna Philharmonic’s website, which can be done at any time. From February 1 through 28 of each year, registered users can submit their ticket requests for the New Year’s Concert preview, the New Year’s Eve Concert, and the New Year’s Concert in their personal account (“My Account”).
4.2.3 Each registered user may apply once for each concert. For the New Year’s Concert, each user may apply for two tickets. For the preview of the New Year’s Concert and the New Year’s Eve Concert, each user may apply for up to four tickets.
4.2.4 Participation in the lottery applies only to the ticket category selected at the time of entry.
4.2.5 Participants in the lottery will be notified in March of the respective year whether or not they have been allocated a ticket.
4.2.6 The only way to obtain tickets for these concerts is by participating in the online lottery. Ticket requests submitted by mail or email will not be considered! Participation in the lottery does not constitute a legal claim to the allocation of a ticket.
4.2.7 Tickets for the preview performance and the New Year’s Eve Concert may be picked up at the ticket office (Vienna Philharmonic Ticket and Ball Office, Kärntner Ring 12, 1010 Vienna, Tel +43 (1) 505 6525) starting in October, but only after the payment process has been completed and upon presentation of the invoice. Tickets for the New Year’s Concert are available exclusively as digital tickets (“Secure Tickets”).
4.3 Ball Tickets
4.3.1 Information regarding tickets for the Vienna Philharmonic Ball and the start of ticket sales for the respective year is available at the Ticket Office and on the Vienna Philharmonic’s website. Ball tickets may be purchased at the ticket office and via the Vienna Philharmonic’s online shop starting from the beginning of ticket sales for the respective year. Please note that only a limited number of ball tickets are available each year.
4.3.2 Reservations for tables and boxes for the next Vienna Philharmonic Ball are possible during the periods specified on the Vienna Philharmonic’s website, though please note that availability is limited. Inquiries regarding this should be directed to the Vienna Philharmonic (by mail or email to ball@wienerphilharmoniker.at).
4.4 Schönbrunn Summer Night Concert
By purchasing tickets for the Schönbrunn Summer Night Concert, you accept the applicable Schönbrunn House and Site Regulations.
4.5 Subscriptions
4.5.1 Information regarding subscriptions is available at the ticket office and on the Vienna Philharmonic’s website.
4.5.2 New subscriptions are allocated based on a waiting list.
4.5.3 To be added to the waiting list, interested parties must submit a request for inclusion in the waiting list by mail or email to the ticket office (Vienna Philharmonic Ticket and Ball Office, Kärntner Ring 12, 1010 Vienna, info@wienerphilharmoniker.at).
4.5.4 The application must include the applicant’s name, address, telephone number, email address, the number of seats, the desired season, and, if applicable, a price preference.
4.4.5 A subscription may include one or two seats.
4.5.6 The application for a new subscription must be resubmitted each year until a subscription can be allocated. If no application is submitted for more than one year, the applicant will be removed from the waiting list. The current estimated waiting time is 10–13 years for Saturday and Sunday subscriptions and approximately 6–8 years for the Soirées. It cannot be guaranteed that a subscription will be allocated at all, nor can the timeframe for such allocation be assured.
4.5.7 If unable to attend, subscribers may consign their subscription tickets to the ticket office. To do so, the original tickets must be brought to the ticket office. Tickets cannot be placed on consignment by phone.
4.5.8 Subscriptions cannot be transferred or inherited. In the event of death, the subscription expires at the end of the concert season (which ends on June 30 of the respective year) following the death.
5. Prices / Delivery / Shipping Costs
5.1 All prices listed on the website and in the online store include the applicable statutory sales tax. The prices valid at the time of ordering apply.
5.2 After the contract is concluded, tickets will be held for the customer to pick up at the ticket office. Tickets are never mailed, which is why no shipping costs are incurred when ordering tickets. Other products from the online store, however, are shipped exclusively! Products ordered through the online store cannot be picked up at the ticket office!
5.3 For the shipping of products from the online store, we charge a shipping and handling fee of €3.50 per order within Austria. For shipments outside Austria, we charge a shipping and handling fee of €8.00 within the EU and €15.00 for shipments to third countries.
5.4 In individual cases, additional taxes and/or duties may apply for shipments outside Austria, which are to be borne by the customer.
5.5 Delivery dates are non-binding unless the delivery date is expressly designated as a binding date. If a binding delivery date is not met, the Vienna Philharmonic will reimburse the customer for the shipping costs.
6. Right of Withdrawal
The right of withdrawal does NOT apply to tickets; concert and ball tickets cannot be returned once purchased; the delivery of audio or video recordings or software, provided that the consumer has unsealed the data carriers.
6.1 For products from the online store, the consumer is entitled to a right of withdrawal/cancellation pursuant to § 1(1)(2) KSchG. Accordingly, the consumer may withdraw from the contract within 14 days of receipt of the product by the consumer or a third party designated by the consumer who is not the carrier, or—in the case of a contract for multiple products ordered by the customer in a single order and delivered separately—on the day the customer takes physical possession of the last product, without providing any reason.
6.2 To exercise the right of withdrawal, the customer must notify the Vienna Philharmonic of their decision to withdraw from the contract by means of a clear statement (e.g., a letter sent by mail or email). The customer may use the attached model withdrawal form, but this is not mandatory.

6.3 To meet the withdrawal deadline, it is sufficient to send the notice of exercise of the right of withdrawal before the withdrawal period expires.
7. Consequences of Withdrawal
7.1 In the event of a valid cancellation or withdrawal, the Vienna Philharmonic will refund the customer immediately, but no later than 14 days from the date on which the Vienna Philharmonic is notified of the decision to withdraw from the contract, all payments received from the customer in connection with the purchase of the product; this excludes shipping costs. The Vienna Philharmonic will also not cover the costs of the return shipment.
7.2 The Vienna Philharmonic will issue the refund using the same payment method the customer used for the purchase, unless the customer has expressly requested otherwise.
7.3 The customer must return the product to the Vienna Philharmonic’s address or hand it over to the Vienna Philharmonic without delay, but no later than 14 days from the day on which the customer informed the Vienna Philharmonic of the withdrawal from the contract. The deadline is met if the product is returned before the 14-day period expires. The Vienna Philharmonic may withhold the refund until it has received the product back or until the customer has provided proof that the product has been returned, whichever occurs first.
7.4 If the product received is not returned or is returned in a condition that has deteriorated, the customer must compensate the seller for the loss in value, provided that the deterioration is attributable to handling of the product that was not necessary for the purpose of inspecting its nature, characteristics, and functionality.

9. Ticket Office Hours
9.1 The ticket office and telephone ticket sales are open during the hours announced on the website and via posted notices.
9.2 On concert days, the box office generally opens an additional 60 minutes before the start of the respective concert. During this time, the box office cannot be reached by phone.
10. House Rules
10.1 Visitors to Vienna Philharmonic concerts at the Musikverein are subject to the house rules of the Gesellschaft der Musikfreunde in Vienna. Instructions from staff must be followed at all times.
10.2 Visitors may be removed from the current performance if they have taken a seat for which they cannot present a valid ticket.
10.3 Audio and video recordings during performances are prohibited. Exceptions require the consent of the Vienna Philharmonic. In the event of a violation, staff are authorized to confiscate recording devices and retain them until the end of the performance. The customer is obligated to delete any recording material containing parts of the event.
10.4 Cell phones, watches with audible alarms, and similar devices must be turned off before the concert.
10.5 The private offering or sale of tickets on the premises of the Vienna Philharmonic is prohibited.
10.6 Bringing food and beverages into the auditorium and consuming them there is prohibited.
10.7 Smoking is prohibited throughout the Musikverein building.
10.8 Bringing animals into the premises is prohibited.
10.9 In the event of a violation of the above regulations, the customer may be removed from the event at any time.
10.10 In the event of a fire or other dangerous situations, visitors must immediately leave the building via the marked exits and emergency exits without delay. The instructions of the staff must be strictly followed.
10.11 By purchasing a ticket, the customer agrees that he or she may be recorded in image and/or sound if authorized persons make such recordings during a public event. The customer has no right to object or to claim compensation if such recordings are published or used.
11. Coat Check
11.1 Items may be checked with the coat check staff for a fee.
11.2 The Vienna Philharmonic is liable for mixed-up, damaged, or lost items only in cases of intent or gross negligence.
11.3 The terms and conditions posted at the coat check apply.
12. Warranty and Liability
12.1 Subject to the following provisions, the Vienna Philharmonic is liable for defects in accordance with the applicable statutory provisions, in particular pursuant to Sections 922 et seq. of the Austrian Civil Code (ABGB).
12.2 The Vienna Philharmonic shall be liable to the customer only in the event of injury to life, limb, or health, as well as for other damages resulting from an intentional or grossly negligent breach of duty by the Vienna Philharmonic, its legal representatives, or vicarious agents. Any further liability is excluded.
12.3 The Vienna Philharmonic shall in no event be liable for defects in delivered products caused by improper handling of the products.
12.4 The customer is obligated to take reasonable measures to prevent and mitigate damage.
13. Data Protection
13.1 The Vienna Philharmonic collects the customer’s personal data in connection with the performance of contracts. The Vienna Philharmonic will comply with the provisions of applicable data protection regulations when processing such data. For further details, please refer to the Vienna Philharmonic’s Privacy Policy, which is available in printable form on the website at any time via the “Privacy Policy” link.
14. Place of Performance, Governing Law, Jurisdiction
14.1 The place of performance is the registered office of the Vienna Philharmonic.
14.2 Austrian law applies, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods.
14.3 If the transaction is not a consumer transaction, the parties agree that the court with subject-matter jurisdiction at the Vienna Philharmonic’s registered office shall have jurisdiction to decide on legal disputes.
14.4 These General Terms and Conditions remain binding in their remaining parts even if individual provisions are invalid. The invalid provisions shall be replaced by the applicable statutory provisions.
14.5 The exclusive language of the contract is German.
14.6 The European Commission offers the option of dispute resolution via an online platform it operates. This platform can be found at the external link ec.europa.eu/consumers/odr/. The Vienna Philharmonic does not participate in dispute resolution proceedings before consumer arbitration boards.
